The right winters of 1990 became witnessed one of the India’s biggest tragedies in the recent past. The land which known for mesmerizing scenes became witnesses of the massive violation of the human right of Kashmiri pandits. It became the witness to the forced migration of Kashmiri pandits from Kashmir valley and atrocious tragic and shameful event. During the insurgency, they were denied of the most basic right the right to life. They were killed, tortured, injured and humiliated by terrorist. Thousands of pandits lost their beloved ones. Their shops and houses were burnt. During the insurgency, there was the massive violation of religious right of Kashmiri pandits. During that period thousands of Hindu temples and idols were burnt. Thousands of Hindus were forced to convert their religion into Islam. Going back to the history, In the middle of 1980s Pakistan revised its strategy on Kashmir issue frontal wall battles were replaced by cross border terrorism in the form of Pakistan sponsored civil war in Kashmir. In 1989 when afghan war had ended Mujahideen’s from the Afghan border were called for the secession of Kashmir from India and its subsequent accession to Pakistan. As the majority population was Muslim, they favored the accession of Kashmir to Pakistan. But it was not as easy as a pie for Separatist because two reason the first reason is that the maharaja of Jammu and Kashmir had already singed the Instrument of Accession with India. And the second and main reason was that the minority population of Kashmir which was composed of Kashmiri pundits was in the favored accession of Kashmir to India. This position of pandit became the hindrance for the separatist. Pandits were considered to be an Indian agent. If Kashmir was become a part of Pakistan, Kashmiri pandits had to be eliminated. As the result they became the first and obvious target of militancy in the Kashmir. On January 1990 after a local newspaper Aftab published a press release issued by Hizb-ul-Mujahideen asking all the pandits to pack up and leave. Another newspaper Al safa repeats this expulsion order. During that period there was the explosion of inflammatory speech made from the pulpit of mosques. During that period about 300 pandits were the slaughtered. Pt. Tikka ram talpoo who was a noted lawyer and a BJP national executive was killed by the Jammu Kashmir Liberation Front (JKLF). Soon after that justice N.K Ganju of Sirnagar high court was shot dead. A Kashmir pandit nurse was gangrape and beaten up to dead. Another woman was abducted, raped and sliced into bits a piece. Many other were brutally injured. Their tongues cut off, eyes gouged off, hands were copped off and so on. As time progressed the exhortation became louder. Whole night Three taped slogans were repeatedly played from mosques. That three slogans were `Kashmir mein agar raha ha toh allah hu akbar kahan hai . Another slogan was that we want Pakistan along with hindu women without their men. The situation had become extremely fierce. There was napak collusion between police, bar, state officials and the press which was dominated by majority community. Whenever they reported their vulnerability to police, they had to face more worse situation. As the state machinery failed to protect them and terrorists continuously hunting their lives, they had no other option but to flee. With this Kashmiri pandits became refugees in their own country. SIGNIFICANCE: The significance of this paper is followed: Through this paper the researcher stressed on the current problems that are faced by Kashmiri pandits. And how they are deprived from a most basic human right. This paper also talks about the failure of government machinery in protecting the human rights of Kashmiri pandits. Issues & challenges: Following the issues and challenges: POLICIES: There are numbers of Policies that are implemented for the rehabilitation and betterment of Kashmiri pandits. They are as followed: In 2004, Under Prime minister’s Package 5242 two room tenements have been constructed at four locations Purkhoo,Muthi, Nagrota,and jagti. These tenements were allocated to the migrant, who were living in one room tenements. Under Prime minister’s package 2008, 200 flats have been constructed at Sheikhpora in Budgam district. These flats were allocated to migrant on a sharing basis, who were government servants. Out of these 200 flats,31 flats have been allocated to the local migrant. In 2008 the Government of India, for the return and rehabilitation of Kashmiri pandits, has announced Comprehensive Package amounting to Rs 1618.40 Crore. Under this package government announced comprehensive facilities for Ex: financial assistance for purchase, construction of the house, renovation of damaged house, student’s scholarship, providing employment and many more. In the budget of 2014-15, Government of India announced Rs 500/- Crore for Rehabilitation of Kashmiri Migrants In 2017, the assembly of Jammu and Kashmir passed a resolution for the return of Kashmiri pandits and other migrants. JUDICIAL APPROACH: In 2017 The Apex court of India reject the petition to reopen 215 cases in which 700 pandits were killed during the exodus of Kashmiri pandits. This petition was filed by the organization name “Root in Kashmir”. By rejecting the petition, the court said that it is too to order an investigation. The court said that it is not possible now to get evidences after 27 years. Court also refused to entertain a plea for re-investigation of the cases and re-trial of several persons who were involved in the act of 1990.
